Missouri AG: Do we legally honor EOs from “an elderly man with a poor memory”?

Since Trump was elected and Biden left office, a difficult question has been hanging in the air: Might at least some of Biden’s executive orders be “legally void,” considering his cognitive state at the time he signed the papers?
Missouri Attorney General Andrew Bailey has written to DOJ Inspector General Michael Horowitz (one of the few holdovers not canned by President Trump) calling for an investigation into whether some on President Biden’s staff might have exploited his mental deterioration to implement far-left policies. These include Biden’s stunning offers of clemency to violent criminals and commutations of Death Penalty sentences on his way out the door.
“I write to request that you conduct a full investigation into President Biden’s mental capacity in his final days in office,” AG Bailey wrote.
He addresses the matter of “standing,” too: “The States need to know because those orders affect us.”
If the Democrats were honest and our Constitution had worked as it should, the 25th Amendment would have been invoked by Biden’s Cabinet and Vice President Kamala Harris would have been sworn in as President. Democrats apparently had their own diabolical reasons for choosing not to handle his incapacity in an up-front way.
“By now, Biden’s mental decline is famous,” Bailey wrote. “Under the 25th Amendment, his inability to make decisions should have meant a succession of power. Instead, it appears staffers and officers in the Biden administration might have exploited Biden’s incapacity so they could issue orders without an accountable President of sound mind approving them.” (To quote all the Democrats attacking Elon Musk and his DOGE staffers, “Nobody elected these people!!”)
Recall that Biden granted sweeping “blanket” pardons to son Hunter Biden, several others in his family, and members of his administration such as Dr. Anthony Fauci, Gen. Mark Milley, and, unbelievably, the members of the January 6 “Select” Committee. Until an investigation is made, we won’t know whether these pardons and commutations are the result of cognitive decline or simply run-of-the-mill high-level government corruption (which apparently will stand, the power of the presidential pardon being what it is).
Some of the individuals described by Biden as “non-violent” drug offenders on his list of 2,500 were nothing of the kind. One of them murdered an 8-year-old boy and his mother. As Katelynn Richardson at THE DAILY CALLER reported, “Biden ignored recommendations made by his own DOJ when he commuted sentences for some of these violent criminals, according to an internal email reported by [THE WALL STREET JOURNAL] in February.”
Bailey cited Special Counsel Robert Hur’s report on Biden’s mishandling of classified documents that described his testimony as that of “an elderly man with a poor memory.”
“It is black-letter law that a document is void, ab initio, when the person signing it lacks mental capacity,” he said.
Recall that when House Speaker Mike Johnson asked Biden about his signing of a moratorium on energy exports to Europe, he said he hadn’t signed such an order when he had. Also, in his final days in office, Biden said the Equal Rights Amendment was part of the Constitution, when it clearly is not.
We know that some of Biden’s aides, along with First Lady Jill Biden, tightly controlled his schedule and even took over some of his responsibilities.
“Who has been running the country for the last few years?” Bailey wrote to Horowitz. “I fear that Mr. Biden, while he held the office of President, did so in name only and was a mere puppet for the far-left, unelected staffers. The people deserve to know the truth.
“I call on you to investigate whether it was Biden or others who took executive actions. If it was not Biden, then the people should know that whatever actions he took were void.”

I agree with Mr Bailey!

PLEASE BE PATIENT, KIND, UNDERSTANDING AND ASSERTIVE…
Before the presidential election in America, I offered the BELOW POST. Since then, Trump has been elected and sad events have occurred: the triumphant religious groups have been thrilled…and others who lead them have remained silent when the marginalized who they should have helped have been hurt…and hurt deeply, young people have been shown that women can be treated as objects, emphasis has not been placed on what the poor need (which is what Judaism, Christianity, Buddhism and other major religions emphasized)…and not how the rich are benefiting from their being excluded), and other awful things have happened.
You may ask, “How could those who voted for someone who is a character disordered sociopath continue to believe this and defend it?
What we all need to see is that a resistance can’t be taken on directly. If you do, you will lose. People prefer ignoring the truth rather than opening themselves to the truth. After all, look how religious leaders still support Trump and others who supported him have not swayed from doing so.
Don’t be discouraged. Do what you can (which is wonderful), remember others who are seeking to do the same…and believe that God and other good souls who walk with you, will make a difference.
All will be well…I will never give up.
BELOW IS THE ORIGINAL POST:
“I DIDN’T KNOW!”
I don’t know much about politics. There are much better persons to consult about that arena of society.
However, I do know psychology—especially my specialties: resilience, maintaining a healthy perspective and leadership skills. I have spoken on these topics at Harvard, Yale, Johns Hopkins School of Medicine, on Capitol Hill, the Air Force Academy, and in 20 different countries. I have had to debrief relief workers evacuated from Rwanda after their bloody genocide, worked in Cambodia after the Khmer Rouge were pushed north, in Lebanon with caregivers brought there from Aleppo, Syria for me to speak to them through an Arabic interpreter, and in other difficult, difficult situations.
If persons such as Nikki Haley and Kamala Harris, who are very different in their views but physically and psychologically healthy, were running, I wouldn’t post anything. After all, people in America have a right to vote for who they believe in.
However, when I see someone like Donald Trump demonstrating organic and functional deficits by not being able to focus, is tangential in his thinking, threatening revenge and prosecution against his enemies, and using crude language (“Kamala Harris is a sh-t Vice President.”) in a large public forum, which demonstrates a lack of normal mental boundaries, I need to speak up.
Whatever your position might be, I need you to recognize that Trump is suffering from psychophysiological deficits that he both denies and excuses. He is a danger as a would-be leader of the United States. I am concerned not only as a behavioral professional but as a former U.S. Marine Corps Officer who always looked to the President as someone to follow no matter whether he was from the Republican or Democratic party.
Naturally, I first and foremost support your right to vote for whomever you wish—that is what democracy and America is all about. However, if Trump does get elected and horrible things happen, saying “I didn’t know”—as some did in Germany after the holocaust—is not an option. This is a serious election. Someone who lies, brags, divides, and makes fun of those who are disabled, is not simply unpleasant…but psychologically deficient. If you are a Republican, you do have the choice of waiting until someone from your party who is healthy runs so your children and grandchildren, our country, and the world don’t suffer the horrible consequences of electing someone whose condition makes him vindictive and authoritarian—which are exaggerations of an inability to truly love another person or the spirit of democracy. In this seemingly close election, the choice is truly yours.
