SCOTUS strikes down the use of race in determining college admissions
In a long-awaited major ruling this morning, the Supreme Court struck down the use of race in determining college admissions as an unconstitutional violation of the 14th Amendment's Equal Protection Clause.
There were two cases, one involving the University of North Carolina’s rejection of non-race-based admissions practices and the other challenging Harvard’s “affirmative action” practices that penalize Asian-American students who were disproportionately rejected despite having higher grades than other minorities who were accepted. The SCOTUS votes were 6-3 on the North Carolina case and 6-2 on Harvard, with Justice Ketanji Brown Jackson recusing herself because she’d previously served on Harvard’s Board of Overseers.
Justice Sonya Sotomayor wrote the liberal dissent, claiming that race-based affirmative action admissions had increased educational opportunity and diversity on campus, and had been used only in a “limited way.” She provided no evidence of that. I’ll bet it didn’t feel very limited to all the Asian students rejected by Harvard purely on the basis of their race, despite them have worked so hard to earn superior qualifications to those who were accepted.
Justice Clarence Thomas wrote that “rudderless, race-based preferences designed to ensure a particular racial mix” “fly in the face of our colorblind Constitution and our Nation’s equality ideal…In short, they are plainly—and boldly—unconstitutional. “While I am painfully aware of the social and economic ravages which have befallen my race and all who suffer discrimination, I hold out enduring hope that this country will live up to its principles so clearly enunciated in the Declaration of Independence and the Constitution of the United States: that all men are created equal, are equal citizens, and must be treated equally before the law.”
While I certainly welcome this decision and hope it will help roll back the recent revival of the odious practice of judging people by their skin color, I’m also bracing for the screaming from many so-called liberals, accusing a black Justice for being a racist because he upheld the principle of equal treatment for all races.
SCOTUS: Unanimous ruling in religious freedom case
In another closely-watched religious freedom case, the Supreme Court ruled unanimously in favor of a Pennsylvania postal worker who was being required to deliver Amazon packages on Sunday in violation of his observance of the Sabbath.
This overturns a 1977 ruling that employers had to "reasonably accommodate" an employee's religious beliefs and practices, as long as it didn’t create an "undue hardship" on the business. People of faith have long complained that employers take advantage of the vagueness of the term “undue hardship” to force them to violate their beliefs, and it can be used as an excuse not to hire applicants with religious beliefs.
The SCOTUS found that it takes more than a minimal cost or inconvenience to establish “undue hardship” and sent the case back to the Third Circuit Court of Appeals for further proceedings consistent with these new stricter standards.
Bidenomics
There’s more “this should be good news, but there’s a downside” news on the economy. The government adjusted its estimate of first quarter GDP growth up from 1.3% to an annualized rate of 2%.
And jobless claims dropped by 26,000 last week to 239,000.
This shows that the economy was much stronger than expected. Normally, we’d be celebrating. But now, the bad news: the Fed believes that GDP growth needs to be slowed down to under 1.8% for some time and the job market cooled to reduce inflation.
I’m sure it must be frustrating for the Biden White House. They’re obviously doing everything they can think of to slow down economic growth and kill jobs, but the US economy is just so strong, not even Joe Biden’s policies can choke it.
Kentucky law struck down for enforcing gender conformity
A federal judge struck down Kentucky’s law banning gender-related hormones and surgery for minors, claiming it’s unconstitutional because it "would have the effect of enforcing gender conformity." I’ve read the Constitution numerous times, but I somehow must’ve missed the section that bans enforcement of gender conformity.
The case was brought by LGBTQ activists and the ACLU (if you support them these days, know that this is what they’re doing with your money.) The court said these drugs are accepted by "all major medical organizations" in the country (yes, and many members of those organizations have complained that that’s due to them caving to threats and blackmail by trans activists and not medical science) and that “these drugs have a long history of safe use in minors for various conditions,” which I guess is why other nations such as the UK have been revoking their support for them.
I expect this to be appealed, since nearly a dozen states have passed similar bans. Kentucky Attorney General Daniel Cameron said, "Senate Bill 150 is a commonsense law that protects Kentucky children from unnecessary medical experimentation with powerful drugs and hormone treatments. There is nothing 'affirming' about this dangerous approach to mental health, and my office will continue to do everything in our power to defend this law passed by our elected representatives."
Reminder: New York State continues to ban giving tattoos to anyone under 18 on grounds that minors are incapable of understanding the ramifications of making permanent alterations to their bodies so adults have to protect them from making bad decisions, and as far as I can tell, the ACLU has yet to say squat about that.
NJ Governor sues NJ school districts for adopting new policies that embrace parental rights
In a related story, if you ever wonder who the Democratic Party really represents these days, here’s a reminder:
After three New Jersey school districts adopted new policies strengthening parental rights, such as informing parents if their kids started using different names or pronouns or the opposite sex’s bathrooms, Democrat Gov. Phil Murphy’s administration filed a lawsuit against the school districts to force them to drop the policies.
The parents are not backing down and say this is purely political; that Murphy is suing his state’s own parents and taxpayers and they will counter-sue. I won’t bother repeating Murphy’s justifications for this because it’s the usual hysterical “trans” activist rhetoric that you’ve already heard ad nauseam; i.e., let the state mutilate confused children behind their parents’ backs or they might kill themselves – a great argument for anyone who’s trying to convince you that they don’t really have a mental issue. You can read all the details at the link.
As for the claim that it’s “medically necessary” to give body-altering drugs, hormones and surgery to confused children or they’ll kill themselves, a landmark study out of Denmark sheds some new light on that. Denmark keeps a medical database on all its citizens, which means a massive 6.6 million person study pool. The study identified around 3,800 people with gender dysphoria, or 0.06% of the population. And it’s true that among them, there was a 3.5 times higher suicide rate and a 7.5 times higher suicide attempt rate than among the general population.
Unfortunately, this study didn’t look at whether the people involved had any “gender-affirming” treatment. But it did note that “Denmark is considered to be one of the best countries in the world for LGBT people.” So despite having a remarkably supportive environment, which I assume includes access to these quack medical procedures, gender dysphoria sufferers still have far higher suicide rates. It’s almost as if gender dysphoria were a serious mental condition whose symptoms include suicidal tendencies and that can’t be cured simply by everyone around the sufferer “affirming” it.
A live stream video of a church service goes viral
It isn’t often that a live stream video of a church service goes viral, but there aren’t many services like those of Minnesota’s Edina Community Lutheran Church, and thank the Lord for that.
I’m not going to pollute my newsletter by quoting their pastor’s "Sparkle Creed" message at length, with its combination of blasphemy, woke buzzwords and "My Little Pony"-level treacle, and its invocation of a “non-binary God,” a Jesus “with two dads” and, instead of the Holy Spirit, the “rainbow spirit.” You can read it at the link, just as I hope that whoever came up with this garbage to mislead the parishioners will someday actually read the Bible.
I talked about this on last night’s “Hannity” on Fox News. I’ll post a link to that video as soon as it’s available online.
Settlement reached
Hunter Biden has reportedly reached a settlement with the mother of his four-year-old daughter, Navy Joan Roberts. While the terms are sealed, it’s been reported in the media that Hunter’s child support was lowered from $20,000 to $5,000 a month, and the mother dropped her demand that the little girl have the surname “Biden.” Well, that’s understandable: Hunter Biden certainly wouldn’t want that innocent little girl to do anything that might bring disrepute to the name “Biden.”
Many are asking if this settlement also includes anything about requiring Joe Biden to exhibit the minimal level of human decency and acknowledge his granddaughter’s existence. Maybe put up a Christmas stocking for her at the White House, like he does for his other grandchildren and his dog. Sorry, but every time I hear some fatuous media sycophant try to brush off Hunter’s illegal behavior by praising Joe for his “unconditional love” for his family, I think of that little girl growing up to learn how her own grandfather was President of the United States and publicly denied and humiliated her.
Ben Shapiro has some things to say about that to which I can only add, “Amen.”
